The 2026 Rulebook Shift: New Jersey, Hawaii, and No Nationwide Ban

There is no federal ebike ban in 2026. The CPSC still uses the ‘low-speed electric bicycle’ definition (operable pedals, motor ≤750 W, motor-only speed ≤20 mph). The three-class model — Class 1 pedal-assist to 20 mph, Class 2 throttle to 20, Class 3 pedal-assist to 28 — remains the state-level default in most of the country.

New Jersey is the exception that riders keep missing. S4834/A6235, with MVC enforcement beginning 19 July 2026, dropped the Class 1/2/3 labels. Every ebike needs MVC registration and a license (a full driver’s license for riders 17+, a motorized-bicycle license for 15–16; under 15 may not operate). Throttle bikes and anything that assists above 20 mph also need insurance. That is the strictest statewide paperwork in the U.S. right now.

Hawaii’s Act 259, signed 15 July 2026, did the opposite of New Jersey in one sense: it wrote Class 1/2/3 into state law for the first time, raised the helmet age to under 18, set a 15+ operating age (16+ unsupervised on Class 2/3), and added a one-time $30 registration. Tennessee’s SB 1782 raised the Class 3 minimum age from 14 to 16 around the same window. Washington’s SB 6110 narrowed what counts as an ebike: a device that can exceed 20 mph on motor power alone, with no pedaling, is treated as an electric motorcycle.

Infrastructure is still local: secure parking, outlets, and lanes that do not dump you into a turn lane. Policy is state-by-state. If you ride in New Jersey, the MVC site is the document that matters, not a 2024 blog post.
