New York E-Bike Laws: Class Three Is 25 mph, and It Is a Throttle

New York § 102-c, opened 21 October 2026: class three is 25 mph, may propel itself, and only in a city of one million or more. A helmet fight is 14 versus 18.

The short answer

New York Vehicle and Traffic Law § 102-c, opened 21 October 2026, caps class three at 25 mph, allows the motor to propel the bicycle, and limits that class to a city of one million or more. Section 1238 requires a class three helmet. The under-14 and under-18 helmet lines are not the same section.

New York’s definition is Vehicle and Traffic Law § 102-c, opened 21 October 2026. A bicycle with electric assist is no more than 36 inches wide, has a motor of less than 750 watts, has operable pedals, and meets the CPSC bicycle rules. Class one assists only while pedaling and ceases at 20 mph. Class two may be used exclusively to propel the bicycle and is not capable of assisting at 20 mph. Class three exists solely in a city with a population of one million or more. It may be used exclusively to propel the bicycle, and it is not capable of assisting at 25 mph. Twenty-five is not the federal 28. A throttle is not the federal class 3, which is pedal-only. Section 1238, opened the same day, requires a helmet for a class three operator, and the section title covers operators and passengers under 14. The September map said under 18 and cited § 1239. This desk did not open § 1239 today. Do not average 14 and 18. This is not legal advice.

The United States pillar is the federal test. The class chart is the vocabulary. The September map is the older desk note.

City layer: the 15 mph cap is already in force. The class 3 bills had not passed. The e-moto bill is a different machine.

What this desk did not do

The minimum age of 16 is on the September map and on Redtail’s table. The section number for that age was not on the page this desk opened. New York City’s 15 mph operating cap is a city rule. It does not rewrite § 102-c. A class three that can do 25 is still over a 15 mph sign the whole time the motor is helping.

Questions people ask

Is a New York class three the same as a federal Class 3?+

No. Federal Class 3 is pedal-only to 28 mph. New York class three may propel itself and stops at 25 mph, and only in a city of one million or more.

Do you need a helmet on a New York e-bike?+

Section 1238 requires one for a class three operator. Its title also covers bicycle operators and passengers under 14. The September page cited under 18 in § 1239. This desk did not open § 1239.

Are class three e-bikes legal outside New York City?+

Section 102-c says class three exists solely within a city having a population of one million or more. That is the statute’s limit, not a city courtesy.

Does New York City’s 15 mph cap change the class?+

No. The cap is an operating rule. It does not rewrite the 25 mph definition. A class three is over 15 whenever the motor is assisting.
