E-Bike Speed Limits

The motor cuts at 20 or 28. The path sign is often 15. NYC is 15 on the street. Pedaling faster is still a bicycle. Unlocking the app is not.

The short answer

Class 1 and 2 motors stop assisting at 20 mph; most Class 3 motors at 28 (New York Class 3 is 25). You may pedal faster. The path sign still wins: Pinellas Trail 20, Tampa Riverwalk 15, NYC streets 15 for every class. Federal product law is motor-only under 20 mph, under 750W, with pedals. Unlocking an app past the sign is not a class — in California, AB 1774 bans speed-mod devices.

E-bike speed limits are three different numbers that the internet treats as one. The motor’s class cutoff — 20 mph on Class 1 and Class 2, 28 on most Class 3 — is when assist dies. The federal product rule (15 U.S.C. § 2085) is motor-only under 20 mph, pedals, under 750 watts. The sign on the Pinellas Trail is 20. The Tampa Riverwalk is 15. New York City streets are 15 for every class. You can still pedal past the motor cut. You cannot argue the app past the sign. This is the 2026 speed desk, not another class explainer — that piece is Class 1, 2, and 3. The 2026 state map is U.S. ebike laws.

The motor cutoff is not a speed limit

StreetLegalHookup’s August 2026 speed-limit note (updated 20 September) still prints the sentence riders skip: Class 1 and 2 motors stop assisting at 20 mph; Class 3 at 28; you may pedal or coast faster — the motor just quits pushing. Priority Bicycles’ class video says the same. Watts do not set top speed. A 250 W mid-drive and a 750 W hub can both be governed to 20. Extra watts are hills and heat, not a legal 35. That math is in volts, amps, and watt-hours. A Level 4 that ‘unlocks’ Class 3 in the app is still a 28 mph assist bike, not a free pass on a 15 mph path.

Federal 20, state 20/28, city whatever it painted

Congress did not write Class 3. Federal product law cares whether the bike is a low-speed electric bicycle: operable pedals, motor under 750 W, motor-only speed 20 mph or less on the level. States borrowed a three-class sticker for where you may ride. eBikeLocal’s August 2026 state hub: assist caps are 20 / 20 / 28 except New York, where Class 3 is 25 mph and only legal to operate in cities of a million-plus — which in practice is NYC — and NYC itself caps every e-bike at 15 mph on city streets (34 RCNY §§ 4-01 and 4-06, effective 24 October 2025, Ebike Oracle). A Class 3 is legal to own in the five boroughs. Operating it at 25 is not.

Oregon still allows 1,000 W in its state definition (eBikeLocal). Almost everyone else copied 750 W. Hawaii’s 2026 road rule, on that same hub, keeps machines over 750 W or 28 mph off public roads. New Jersey left the class system for ‘motorized bicycles’ with license, registration, and insurance — the speed sticker is not the fight there. Washington’s 2026 definition fight (ESSB 6110 / later bills, Surface 604) is about bikes that unlock past class. The pattern is the same: the number on the hangtag is a ceiling the city can cut.

Florida, because this desk is in Tampa

Florida Statute 316.003 still uses the three classes: 20 / 20 / 28, pedals, 750 W, no license for a bicycle-class bike. Local trails add a second cap. Pinellas County Sheriff, reprinted by the City of Dunedin (25 March 2026): e-bikes are bicycles on the Fred Marquis Pinellas Trail; the trail speed limit is 20 mph; under-16 helmet; no illegal mods. Deputies ran a speed study and said most riders were already under it. That is not permission to GPS 28 in a Class 3 livery.

A December 2025 proposal to drop that to 10 mph with a wheelie ban was rejected unanimously — 15 stands. CS/SB 382, which would have added a statewide 10 mph-within-50-feet-of-a-pedestrian rule, passed both chambers and was vetoed by Governor DeSantis on 25 June 2026 (Ebike Oracle, The Cyclist Choice). It is not law. Yield-and-audible-signal duties that already lived in §316.2065 still do. If a blog dated July 2026 treats the 10 mph bubble as statewide, it is quoting a dead bill.

California: 20, 28, and do not unlock it

California is the three-class system with extra teeth in 2026. Class 1 and 2 motors cut at 20. Class 3 pedal-assist cuts at 28. Class 3 stays off most Class I multi-use paths unless a local ordinance lets it on. Helmet for every Class 3 rider, 16+ to ride one. SB 1271: throttles belong on Class 2; Class 1 and 3 are pedal-assist (walk-assist under about 3.7 mph is the usual carve-out). AB 1774 bans selling, installing, or using devices or software meant to override speed limits or assist modes (eBike Travelers, Riding5, 2026). That is the derestrict dongle and the ‘off-road’ app toggle sold as a Class 2. If the motor can exceed 750 W or the class speed even for a burst, California can treat it as a motor vehicle. Do that at your own risk; a shop that will not touch AB 1774 work is doing you a favor.

What is not an e-bike speed limit

A Tuttio, Villain, Light Bee X, or Talaria MX4 is not in this table. RiderGuide GPS on the Villain was 44.3 mph. A 2026 Light Bee claims 50. Those are e-motos. They fail the federal bicycle tests. Pinellas Trail’s own checklist (Dunedin / PCSO): if you are not under 28 mph, 750 W, with working pedals and no illegal mods, you are a motor vehicle and you do not belong on the trail. Controller maps that add field weakening for top speed are how a used stator dies, not how you become Class 3.

E-scooters are a different ordinance in most cities — often 15 mph or a device cap, sometimes banned from the same path. EU pedelecs cut assist at 25 km/h (15.5 mph) and 250 W continuous; a speed pedelec at 45 km/h is usually insurance-and-plate territory (Bike-EV 2026). Importing a 45 km/h EU bike and calling it Class 3 in Florida is how you meet a deputy who can read a spec sheet.

GPS, dash, and the unlock

Wheel-size in the display lies. A 26-inch setting on a 20-inch folder reads fast. GPS on a phone is what published testers use — Electric Bike Report’s Level 4 loops, RiderGuide on the Villain. If you care whether you are actually under 20 on Pinellas, GPS. The hangtag is the class. The sign is the law you are riding under right now.

How the cutoff is implemented is a wheel-speed sensor or the motor’s own rpm table, not a cop. Cadence hub bikes often feel like they shove to 19.8 and fall on their face; torque-sensor mid-drives fade the assist so 20 does not feel like a wall. Either way the legal event is the same: the motor is not allowed to add watts above the class number. Downhill at 32 mph on a Class 2 is still a bicycle if you are only coasting. Throttle at 32 is not. StreetLegalHookup’s path note is the enforcement reality: many multi-use paths post 15 mph for every wheeled user. Class 3 is barred from a lot of those paths even at 12 mph. The sticker got you onto the asphalt. The paint keeps you at 15.

Retail ‘street legal in all 50 states’ is a lie with a hangtag. eBikeLocal: eight jurisdictions still do not use the Class 1/2/3 labels (Alaska, Kentucky, Montana, North Carolina, Pennsylvania, South Carolina, D.C., and Massachusetts has no Class 3). A bike that is a clean Class 2 in Florida can be a moped paper in New Jersey after 2026. Read the 2026 rulebook before you ship a 28 mph bike to a cousin. Road speed limits for cars still apply on the street — a 25 mph neighborhood is not a Class 3 playground. Bike lanes are not an exemption from the number on the white sign.

Aventon, Lectric, and a pile of 2026 commuters let you pick Class 2 or 3 in firmware. That is legal only where Class 3 is legal and you wear what the state wants (California: helmet, 16+). It is not legal on a 15 mph Riverwalk. AB 1774-style bans on speed-mod kits are the direction, not a California-only mood. Bosch Performance Upgrade 2.0 (from 4 May 2026) still lists 750 W peak — software torque, not a 40 mph cheat. If the bike needed a dongle to ‘remove the limiter,’ you left the bicycle aisle. The mods we like do not include that dongle.

Buy the class that matches the slowest place you actually ride. If that is Pinellas and the Riverwalk, a Class 2 that stays at 20, ridden at the posted 15–20, with a helmet you will wear, is the nationwide-sane commuter. If that is a 35 mph suburban arterial and your state allows Class 3 on the road, 28 mph assist with a speedometer is the product. E-scooter caps (often 15 mph in the same city ordinance) are not this article — different device, different ticket. The motor cutoff is a feature. The sign is the limit. GPS it once. Then ride the number you saw, not the number in the ad.

What is the e-bike speed limit in the US?+

There isn’t one number. Class 1 and 2 assist cut at 20 mph, Class 3 at 28 in most states (25 in New York). Cities and trails post lower: NYC streets 15, Tampa Riverwalk 15, Pinellas Trail 20.

Can I pedal faster than 20 mph on a Class 2?+

Yes. The class number is when the motor stops assisting, not a hard vehicle governor. Posted path and street limits still apply.

Is New York’s Class 3 28 mph?+

No. New York Class 3 is 25 mph and only operable in cities over 1 million (effectively NYC). NYC then caps every e-bike at 15 mph on city streets (34 RCNY, 24 Oct 2025).

What is the Pinellas Trail e-bike speed limit?+

20 mph, per Pinellas County Sheriff / City of Dunedin (March 2026). Legal e-bikes are treated as bicycles there. A 28 mph Class 3 still has to ride 20.

Did Florida pass a 10 mph-near-pedestrians rule?+

No. CS/SB 382 was vetoed 25 June 2026. Yield-and-signal duties already in statute remain. Tampa Riverwalk/Bayshore stay at 15 mph.

Is unlocking Class 3 in the app legal?+

Only where Class 3 is legal and you follow helmet/age rules. Not on a 15 mph path. California AB 1774 bans devices and software meant to override class speed limits.
